domestic enq and enquiry officer

In my case on PI of fairness of Enq. The workman appeared first and lead evidence but the employer says that Enq. Officer is not available for witness on PI , what will be effect if EO will not present ? whether employer can lead secondary evidence on PI > Please rePly with judgement on this issue

If enquiry officer do not appear as a witness then the employer has no other option but to seek the permission of the PO of LC to lead secondary evidence and he has to prove his entire case there.

If presenting officer on behalf of disciplinary authority was appointed in the domestic enquiry, he can prove the enquiry proceedings.
