Hi, I am asking on the behalf of my cousin. Actually he is arrested in the dowry case due to his wife have got commit suicide. He surrender himself and now he in prison since last 1 year. The opposite party member have written complained for the whole family member. However, his mother and father have come out from prison within 3-4 months after get bail but he is still inside of prison since last 1 year. He has also applied for the bail in lower court but it was rejected. Thereafter he tried to get bail in high court but there is no response from High Court because his advocate always say that he is trying his best but no output is coming since last 1 year.
When his wife get commit suicide that time he was away from his hometown because he did work in the field of Civil line so, he used to go to his home in very minimum time. Although, he used to go home twice in a year but that time he was not available on the time of suicide.
So, I just want to know your suggestion about this case that what will happen with his case.
Because my cousin is saying that he will not be able to come out from prison if this thing will run in such way. He is so much worried about his case.
Please suggest me so that I can give advice to him.

Online advice cannot be given as entire case file papers to be examined before tendering any advice. If his advocate is not delivering the things, you can change the advocate.

I don't agree with the answers of his lawyer,something is wrong somewhere.The lawyer I presume is playing mischief. Did U establish that he was not present when his wife committed suicide.

Bail orders depend on facts on file, arguments and court.
You should consult some senior lawyer and show him full case file.

Engage a competent lawyer in HC and move the bail application or else once rejected even in the HC it becomes very difficult in SC.

If the Police have completed the investigation and / or filed the charge sheet, then there is nojustification to keep the accused in jail pending trial of the case. Of course the Prosecution always opposes application for bail on the ground that the accused may tamper with witnesses / evidence or may leave the jurisdiction of the Court.Hence as suggested by experts u may engage a senior lawyer to plead for the accused.

I agree with experts advise, if you are not satisfied with the performance, guidance, advise and proceeding of his (your cousin's) lawyer, it would be appropriate to engage some other prudent lawyer and change him. The circumstances explained in the query reveal that the charge sheet has been filed and the prosecution evidence is to commence, isn't it? In that case, it should not be so problem in the grant of bail by HC.

Thank you all, well charge-sheet has been filed already. So, conclusion is that he should change his lawyer and hire Sr. lawyer to get this case resolve soon?
