Hello sir, one of my frnd got married at arya samaj mandir in Delhi in 2011. They also got mandir certificate. But since the marriage date, they have never been living together. Neither they have disclosed this to parents.
Due to continue fights and lack of understanding they got seperated oraly..girls says she doesn't want to live with the boy..nor she is making him free legaly or on papers. Now pls suggest what can be done..they stays in same city but not met since last two years..they are both of same cast. Girls says to boy that you can get marry anywhere..she has no problem. But boy don't want to believe on words only..boy's parents insisting to get married...plz ssuggest if boy get married somewhere else without any legal procedure of separation, side effect may happen... Girl is not supporting in any manner either to live together or for separation...plz suggest

MArriage is binding and subsisting. unless divorfce is pronounced by court is other marriage will be illgal and he be liable for bigamy. None will believe that his parents did not know of earlier marriage and they can also be taken as abettors.
if he marries another girl by hiding this marriage (every one will believe that he had hidden even if he disclosed) then he is also liable for rape as it can be alleged that he obtained sexual consent of second wife by making her to believe to be lawfully wedded wife (whereas she will not be). None will believe that his parents did not know of earlier marriage and they can also be taken as abettors.
First wife can anytime demand maintenance.
Further he can also be open for false allegation that he refused to keep first wife as dowry demand of his family was not met and his entire family will run for bail.

No other way. only court has to dissolve the marriage.

I shall be highly obliged if you can contract the person (not in movie/TV serial) from whom you heard this and get the exact law where it is laid down and enhance knowledge to this forum.
