(Querist) 30 March 2016 This query is : Resolved
My case is about a guy cheating me sexually exploiting me with a promise of marriage. And during trial as the lawyer from the guy end have not appeared judge closed my cross examination. After that guy filed a petition that cross examination should be done. My question is will it be done to me after it was closed. And if not does it mean that case is in my favour?

Depending upon the reasons cited in the application, the Court has discretion to allow them for Cross examination (With a view to give an opportunity such applications will normally be allowed.

If you were not Cross examined that alone does not mean the case goes in your favour. But while giving the judgement, the court will not have strong ground to acquit the accused. However, the Courts will/should see the oral, circumstantial and also documentary evidence, while deciding a case.

Yes, if the reasons behind the failure to cross examine you earlier is accepted by court, your evidence would be reopened.
