Compulsory bond for nurses

(Querist) 02 June 2017 This query is : Resolved
I m working in NIMHANS Bangalore as a staff nurse. Here we have signed a compulsory bond for 5 years. I would like to know whether any possibility of bond transfer or breaking of bond in order to join another government institute withount giving compensation(3lakhs). There is no provision mentioned in bond rules and regulations. This compulsory bond obstrucing many of the staff to better carreer opportunities under govt of India itself. There is no other staffs having bond in nimhans. Even in India by law, bond taking in private hospitals are prohibited. Please suggest your expert opinions .

Breaking of bond is not possible, but transfer of bond is possible, provided you apply for job in any other Government institute only through proper channel (not directly).

The said Bond could be due to subsidized fee/charges.

Either pay liquidated damages or transfer Bond………………..

Until or unless the said Bond is rendered unreasonable/unconscionable/void by court of law, it might be valid in your case.

Agree with the expert P. S. DHINGRA.

I agree with expert Mr. PS Dhingra.

If you break bond keep Rs. 3 lakh in your kitty/bank to pay to NIMHANS, if you did not apply for a new job directly. It would be better to apply through proper channel.
