Can we take legal action against those drivers who intentionally does not look after maintenance of commercial vehicles even after warning given by the vehicles both verbally and indicating display for top up of lubricants/water in Engine/battery resulting engine and battery damage

What is the legal action you are contemplating? Are the drivers your employees or only those on contract?

It is merely a management issue, not a legal issue with your own employees (regular or contractual). Maintenance of proper discipline among the employee, or recruitment of well trained and disciplined drivers, or to maintain your supplied vehicles is your own responsibility. Why leave everything on your illiterate or semi literate drivers?
