Conversion of criminal revision application to writ petition

Sir/Madam,

We filed Criminal Revision Application in Gujarat High Court against the refusal to discharge us in CBI Court under Section 397 of Cr.PC.

Now, it has been decided to convert this Revision Application filed in Hon'ble HC to Writ Petition to enlarge the scope of the decision making.

Kindly inform the process to be adopted for this conversion in Gujarat High Court.

With Regards,

Section 88 of Indian Evidence Act-Fax copy-admissibility in Criminal Court.

Sirs,
Section 88 of Indian Evidence Act presumes that a telegraphic message is delivered. I request you to enlighten me about the Fax copy. Whether both ends to the tranmission of Fax copy have to be proved for the purported fax as admissible evidence, when the accused is contesting the same in a criminal case?
There are sections in the Evidence Act with regard to electronic records, but silent on fax transmissions. Please clarify.
Thank You Sirs.

Discharge Application

Sir,
In a CBI case relating to PC Act, 1988, if a person files a discharge application, Before framing the charges.
While referring to any documents filed with the chargesheet, does it amount to accepting the documents.
Even for pointing out technical or factual errors in the chargesheet, I feel that in the discharge application that some documents filed with the chargesheet have to be referred. In that context, whether the cbi can say, at the time of trial stage, if not discharged, that the documents are not disputed by the accused..?

Thank You,
