False date of birth to bar council by an advocate!!!

(Querist) 04 March 2013 This query is : Resolved
Here an interesting case about a learned advocate, registered in BAR council and has not practiced for about 18 years excepting first 2 years of registration in Bar... thereafter been doing only full time Business of a consumer goods & money lending agency...
An RTI applicant has got certified info on this ADVOCATE proving that HIS DATE OF BIRTH GIVEN BY HIM IN BAR ENROL APPLN IS DIFFERENT FROM THAT OF REAL ONE (AS PER BIRTH CERTIFICATE)...... i.e DOB in birth certificate SHOWS YOUNGER THAN DOB GIVEN IN BAR APPLN.... ALSO GOT PROOF OF TIN /CST NUMBERS OF ADVOCATES BUSINESS UNIT....

BAR council is not aware of all these as none has reported so far and BAR replied that the liecense of the said advocate is currently valid....

Questions are

1. To bring this erring advocate before law... should the party file case IN RESPECTIVE BAR COUNCIL? OR HIGH COURT?

2. should it be filed under Advocates Act or any other relevant act if any?

3. Is there any way or records that may be available to verify whether the particular advocate has handled how many cases in a year or frequent time period in our country s judiciary system?

4. Other views please on best way to bring those erring advocates before law

1. Complaint with Bar Council in prescribed format.

2. Section 35 of Advocates Act.

3. There is no such system as on day.

4. Bar councils are these days taking strict action against such so-called lawyers so move ahead.
