(Querist) 14 November 2012 This query is : Resolved
hi expert police has filled charge sheet u/s 498a,323,504 ipc and 3/4 dp against me and my parents under political pressure. we did not get bail by now. i have solid grounds which can prove fir and chargesheet false and concocted. no action to counter this false fir like revision or quash has been taken by me.my query is that . is there any remedy which can help me not to attend the court by my parents for getting bail. i am ready to surrender before court and getting bail but i dont want my family members face the situation of surrender and apply for bail.police has summit charge sheet in court.

Hi Rashid Somehow u r querry is somewhat not clear. if u r nt on bail than u might under arrest or shown as absconder.
Any way I am coming to u r querry as about false charge sheet. If u think its very much false charge sheet and u have prima facie evidences to prove the same than either u might apply u/s. 482 to quash said FIR before high court or apply in mag court to get discharge u/s 245
Consult on this two points with u r local advocate.

Hope this answer is to u r satisfaction. Answer is given by Adv. Ramesh Chheda - 9870112826 from mumbai who is expret on the laws of criminal laws and related to marriage criminal laws. if u have any further querry u may raise further querry in continuance with ths.

you have stated that you did not get bail till now . Did you make an application for anticipatory bail for yourself and your parents . ?

if charge sheet has been filed better contest case on merits . if you feel you have striong prima facie case on merits move high court for quashing
