Fate of Decree / Order under Consent Terms ?

While I am in the process of filing Execution Petition in the City Civil Court , Mumbai for execution of decree / order passed by it in 2009 after filing of Consent Terms by me and the defendants a new issue has cropped up and worrying me. Two of the defendants and their family members are at loggerhead as one of these have broken in the room in possesion of other and thrown out their belongings resulting in filing of a private complaint in MM's Court as police did not registered the FIR. Their advocate has suggested that the MM may order sealing of the flat which is detrimintal to my interests as the flat is required to be sold as per decree / order passed in 2009.

Pl. advice:

a) If MM can order the sealing of the flat?

b) Will it affect Execution Petition that I will file after court vacation ?

Without worrying about anything just you file a execution petition before the concern court. In the year of 2009 its self its decreed in favourt of you. Then why still you are waiting.

Your execution petition's proceeding and private complaint's proceedings both are entire difference. So just leave your worry. Magistrate court can't stay your execution petition's proceedings.
