Querist : Anonymous (Querist) 31 March 2021 This query is : Resolved
If my Father execute his WILL (unregistered) witness by 2 of his friends, in son name 30 years back but one year before his death he told me that I had send WILL copy to some Deptt., but I didn't remember which department if I can check now with sub registrar or L&DO is it beneficial for me or not.

Hello,

The will is not registered so the sub-registrar office will not give you any information about the will. The mutation is made on the basis of will only after the death of a person. So L&DO office will also not have any information about the will.

You stated that your father sent the copy of the Will to some department. I opine the Will in original might have been sent by your father in a sealed cover to the District Registrar of the District concerned for deposit of the will. If you are a beneficiary of the Will, you have to submit the death certificate of your father and legal heir certificate, you have to submit an application to the Registrar, and then it will be opened and as per your wish, the Registrar will take action.

You can not find copy of "unregistered" document of Will with either of the authorities.

If the document is not registered no public authority will keep it. Infact registered documents original will have to be handed over to the person who is registering it. It may be with your family lawyer or family friends including the two witness friends. You can check up with your family members also
