Filing case against buider in consumer/high court

i had purchased resale flat in year 2011 from original owner who had purchased in year 2006 from buider the buider have not formed society till date to various residents apartments ,the residents have formed society but it is not registered under the registrar cooperative society act og maharashtra the unregistered society is contemplating to file case against the buider for not constructing road and sewage trearement plant in the above circumstance i want to file separate case against the buider in mofa act 1961 can i do so or nor

in my opinion you cannot because you have not purchased the property directly from the builder. You have purchased it from original owner.

Even if you purchased the property from the original owner, you entered in the soe of your earlier seller so you have also got similar right to agitate.
