Fir not getting lodged against builder

Querist : Anonymous (Querist) 20 October 2024 This query is : Resolved
Hi I have given a complaint in police station against builder for not giving possession as per agreement. The builder has not given any reason for delay and no construction done for last 13 yrs.
Police is not taking any action for last 4 months after taking my statement. Like me there are 20 memebers who are on road. RERA case is also not getting on the board for last 1.5 yrs. What can I do to ensure Police take action and I get my money back with interest
T. Kalaiselvan, Advocate (Expert) 20 October 2024
Police can take action only on a reported crime.
If the police is not taking any action against the complaint then you may approach the judicial magistrate court with an application under section 156(3) cr.p.c. seeking direction to the concerned police to initiate proper legal action against the accused as per law expeditiously
Dr. J C Vashista (Expert) 21 October 2024
Delay in handing over possession is not a crime where police may intervene, take any action or render legal help.
You have the option(s) to move to either of the following:
Consumer Commission;
RERA; and / or
Civil Court for specific performance with consequential relief(s)
Take a decision seeking professional services of a local prudent lawyer.

Police will do nothing in your case, knock the doors of Consumer Commission.

File a case against the builder in the Consumer Forum.
Sudhir Kumar, Advocate (Expert) 23 October 2024
Police is no substitute f Consumer Court.

Builders are generally moneyed people and Police will dare not take illegal action against him simply on your request.
P. Venu (Expert) 24 October 2024
Yes, the police cannot interfere or adjudicate a civil dispute. As already suggested, you have option to move the concerned authorities or the consumer court.
