Forceful sealment of property by smc

(Querist) 08 March 2013 This query is : Resolved
Hello Sir, we have been living in SMC Quaters for around 10 years. We have been paying installments since last 8 years due to my father's retirement we haven't be able to pay the dues, therefore today without any notice they just came to our house & asked us to pay a lumpsum amount of Rs.7,968/- on the spot else they would seal the house. They were officers of Municipality & just on a rough paper they wrote the amount & went. We asked them for time duration but they weren't ready to listen. We intend to pay them after 3 months as I would be getting job next month & salary after that. My father is aged & my mother is also housewife, please if any advice i can get on this to avoid sealment of my house & get time period to pay the dues. Need help urgently. Thank you.

Issue legal notice to the municipality to provide the details of the due amount payable by your father and also request them for instalments.

Thank you sir for your reply, the thing I want to know is whether they any right to seal the house without any notice, without giving any time period & sealing the house on the spot. Because they are just recovery officers so how to handle them at that moment. No legal Notice has been issued till now. They might be revisiting on Monday. Please advice on this.

Anyway you can always challenge the act of the authority by filing writ petition in the high court.
