Gain legal heir rights on mother's sister assets

Dear Experts,

This is Srinivas, aged 28, living in Tamilnadu.

I have been brought up by my aunt(My Mother's sister) and Uncle. In fact Me, my parents, my uncle & aunt live together.

So there was no legal adoption since we live as single family. Currently my uncle has some fixed deposits and i have also pledged gold using his bank a/c.

Currently I don't have any legal proof stating that I am the legal heir for the assets owned by Uncle.

Kindly help me in understanding the necessary legal proofs required to become legal heir to gain ownership of my dad and uncle's assets.

If you are Hindu,the adoption may have to proved if deed was not signed.


If adoption is proved then you may not be able to get share from biological parents.

If your Aunt/Uncle whoever is the owner of assets are alive then they can write WILL in your favor.


Likewise, if, your father/mother whoever is the owner of assets are alive then they can write WILL in your favor.

I have one more query in connection to my previous thread.

Incase of any misfortunes, How will i be able to claim the gold which was pledged in my uncle's bank a/c. Even during this situation a will is required ?

The owner can mention the disposal of any asset in WILL.


Madras being presidential town it is mandatory to probate the WILL.

It shall be better to register the WILL.


You may also consider the option of clearing the debt and getting back the gold that belongs to you.


Further you may discuss with an able counsel at your location.

Your uncle can nominate you in the account / can give instructions to the Bank accordingly.
