Sir, my mother wants to gift her flat to my son but at present he is in US. Please kindly tell us the procedure to be followed.

She could send A Power of Attorney to her Grand Son Duly Attested by Authorised Officials of Indian Embassy there.The POA holder and the Beneficiary could be Same and Basing on the POA the Grand Son him self Could Execute and Register the Deeds in his favour.Consult A Local Good Advocates and get drafted the POA and Send it to the Mother.

She can send POA in favor of some person other than beneficiary to execute gift deed on her behalf.

The beneficiary (grandson) need not be present at the time of registeration of gift deed, he can accept and sign the deed as donee through POA.
