Querist : Anonymous (Querist) 31 July 2011 This query is : Resolved
Hello,
My colleague, employed with Government Department (Andhra Pradesh Government) was placed under suspension, for involving in a criminal case. Later he was acquitted of the case on benefit of doubt. Can the suspension period be treated as the employee on duty and is he eligible for the monetary benefits thereof. Please clarify
R.Ramachandran (Expert) 31 July 2011
The suspension period would be treated as period of duty and fully paid only when the official is "completely exonerated" and not when actuitted on the basis of benefit of doubt.
Chanchal Nag Chowdhury (Expert) 31 July 2011
Yes, provided there is no domestic enquiry pending.
M/s. Y-not legal services (Expert) 31 July 2011
Yes. He is eligible. Because no charge has been proved against him.
K.S.Srinivas (Expert) 31 July 2011
The period of suspension shall be treated only when the employee is honourably acquitted in the criminal case i.e., not on benefit of doubt.
Kirti Kar Tripathi (Expert) 01 August 2011
No, the result of suspension will depend on final out come of disciplinary proceedings. Benefit of doubt in criminal proceeding has no role in disciplinary proceedings.
