Gpa holder is not giving the advance back

Hello Friends,
I made an agreement to but an house consutructed from GPA land owner in February by paying 2 lacs as advance and he asked additional money breaking the rules of agreement.
GPA holder has broke the agreement and promised to pay the advance in June.
Till now he is absconding with out returning the advance.
Can some one help me how to get the money as per law

you have right to file a criminal case u/s 406 of IPC and civil suit for recovery against him before the court.Section 406. Punishment for criminal breach of trust
Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
CLASSIFICATION OF OFFENCE
Punishment—Imprisonment for 3 years and fine, or both—Cognizable—Non-bailable—Triable by Magistrate of the first class—Compoundable by the owner of the property in respect of which breach of trust has been committed, with the permission of the court.
