gratuity is part of my monthly package. after serving for about 3.5 years i resigned from service. now the employer isrefusing to give gratuity alleging that the same is payable only after 5 years of service.
i told him that gratuity in my case is not governd by gratuity act as you voluntarily agreed to pay me gratuity and not under the act.

as per law who ever working 5years in same company only applicable gratuity. this is minimum standard.

If payment of gratuity was part of the agreement between you and your employer, payment thereof cannot be denied. You can sue your employer.

I think Mr.Praveen is right as in present case the employer has voluntarily agreed to pay gratuity to employee.
