hi , i want an advice what to do
i was a minor when my mother and my aunty where doing business from home and where friend , my aunty use to bring cloth for sell to my mother and my mother use to sell them from home and use to get some money for sell from my aunty , but my aunty was very agreedy she use to fight with my mom for even 10 rs , ever time i have to go to my aunty house to give her money for what cloth where sold , and she use to give commission for same and she use to write for same on a book , one day when i went to her house for giving money for the cloths sold , she had very big fight on phone with my mom and she give commission money to me and took my signature on that accounting book which she had maintan , these is the time in 1994 , these contiune till 1998 and one day my mother and my aunty has big fight for commision money and they stoped the business
and even bad words where used in fight from both side , from that day my aunty is after me and every time when ever she sees me or my family starts shounting on road or any where , many time she comes in our society and also do all such things , she say she had given money 705000 rs to me ( jatin ) and she want that with interest on that , she had made all figures on that accountimng book on which she had taken my signature and now she threatening us haressing us every now and then , she had made police compain against me mamny time police man comes and take me to police station and take my statments , and now she had thearten of court to us
she is saying she had lended 705000 rs to me in 1998 when i was minor as i am born in april 1979 , i want to know from so many years she is harresing me and my family and she is thearting us what should we do , we have not taken any mony , but she has taken my signature on account book which she use to give us commision that is a plain note book , but she has changed all figures form 200 rs to 200000 rs and know she is coming to my busines place also very now and then and making us feel so embrass and i am crying
can she haressme for such way , i am today of 33 years and still afraid of her please advice me what to do , as we had done cross NC in local police also
aunty stays alone witgh her daugter and her husband has left her and also her son has left her they are not staying with her
i am in a troma please advice , she has gone to bandra highcourt for free advice on these and bandra court is calling us to attend the court and tell our side before they advice her , few day before a local police came to give us thet bandra court notice
i am worried after so many years can she do a case on me , i was minor when i did that signature and had not taken money also please help me advice me

Don't worry, everything signed by u is in the age of minority moreover, more then 3 years passed her claims are time barred

Minor cannot make any agreement, so dont worry. Say your aunty what she want to do, do it.

tell your aunt to take whatever action she wants . her claim would be barred by limitation .
you have staed that you signed in 1998 . more than 14 years have passed and you have till date not acknowledged any liability .

thanks very much sir , these has given me much strength and also i want to know , now my aunty has gone to bandra court for free advice center and from there i have got a notice requesting me to atten the court and say my side , and in that notice they have request me to come and say my side , i had return a letter to the court that i will atten the same in next month , but last week a local police man came and gave me that notice and i have to appear on 18tha may
please advice what should i do
as i have seen many times when polics use to call me they use to take the side of aunty as she beening a lady she gets more power the a man in law
i donot know but your words will surly help me and i had signed on 15/jan /1998 and i complete 18 years on 30/4/1998

Dear Jatin,

1. First of all; keep all the facts in your mind in chronological order about all the business activities like following :
a. For how long the business was carried out by your mother and don't forget to say you were just helping her to handover collected money and receive commission in turn.
.
b. Keep a rough track of amount of commission received in the past every week or month.
.
c. Estimated figures of sales being made every week/month by your mother.
.
d. The place where she used to deliver the goods.
.
e. Names of some of the customers to whom your mother used to sold goods and estimated amount thereof every year.
.
f. Your lawyer can ask counter questions as such :
.
i. The volume of her business to prove that she could earn that much money to lend you huge money. Whether she has paid taxes thereon and shown the amount in her income-tax records ?
.
( Even if she has shown it; the matter is time barred. But I am sure she might not be so "clever" in this regard to pay huge taxes ).
.
ii. The contention to give you money regularly when nothing was repaid in turn for long time will also prove her wrong.
.
iii.Your family structure will also prove that you don't have any investment out of such huge money.
.
THE MOST IMPORTANT :
.
DON'T ARGUE WITH ANYONE EITHER IN POLICE OR COURT; THAT THE MATTER IS TIME BARRED.
.
This matter will be automatically decided by the court that the issue is time barred.

But to appear before court; you should hire the services of one lawyer.

Hence; without waiting for more "free advice"; you should immediately contact one civil lawyer.

sir my aunty has gone for brandra court for free advice an in that system is such that u have to go and say your points and on that they will advice my aunty to do what ,
so i was wondering should we go r not for such thing , and so i was not going but last week a local police man came and gave me that notice and said i have to go and attend that at 18 /5/2012
so over there no lawyer is required , only i have to go and put my points , as i was minor i will say that , i want to know what if i donot go , that court is for free advice bench they do not give any deission they just call both party and listen to them and then give advice to both party what to do
so i am thinking what to do as being a women she get more benifit in law , but will that court give sumons to arrest me if i am not attending the court
please help me in these points
i will attend the court but from 15 to 1june i am out of station , so i will send my parents to attend that will that do

i would request u to please advice us , as my aunty has gone to bandra to maharashtra vidhi seva kandra , for free legal help and advice , there they call both the parties the complainent and complainer and they listen to both party and then advice the complainer what to do
i was getting notice in which they use to request me to come and say my points , i did not got the time to go so i ignored that , but last week a local police man came and gave us the notice ,
and i have to attend that on 18 may
but i am not there from 15 may to 1 june
so what should i do , and if i donot attend will they do any thing to me , or can they arrest me

its a bench for helping people in domestic violance like marriage , dowri etc ,

and i will try to attend in there next date , but my point is as i have not taken money and i was minor and also its 14 years has past , what she can do , can she do criminal case or its civil matter

as i am a small business man with a small family and every thing of my family is on me , so any thing if happen to me will cost us and my family
