Illegal land sale

(Querist) 19 March 2015 This query is : Resolved
Sir, my Grand father (Mother's father) owns an agricultural land of around 7 acres. He has 5 sons,3 daughters. I am the daughter of youngest daughter of my grand father. all the sons and 1 daughter stay in Malaysia. My mother used to look after the land for the past 10 yrs on behalf of my grand father. He passed away some 9 yrs back. 1 year back, my uncle's wife (Uncle passed away) collided with one of the daughter's son, who is a lawyer and both of them sold the land to a politician. Even though we have filed a case against the buyers, the case is not doing well. My uncle's wife's address is not available. She escaped after selling. This Lawyer cleverly managed not to have his name in any document sold.I want justice for us and the culprits My uncle's wife, lawyer, revenue officials have to be punished. How to proceed?? Please guide

I feel u have a good case to defend, if there is no partition taken place till date. All 5sons & 3 daughters are eligible for their legitimate 1/8th share in the said property.

The said sale is binding only on their share in the said property. U can exercise u r rights by FILING SUIT FOR PARTITION & SEPERATE POSSESSION OF YOUR EXTENT in the said property. U can feel free to mail me on sohan1912@rediffmail.com for more assistance. Rgds

Your uncle's wife could sell her share from 1/8 th share of your uncle.

The lawyer has no name on the documents, no case lies against him. Similarly no case lies against the registering authority.

Consult local lawyer and proceed with the case on merits.

My friend, who joined with State Bank of India as Probationary officer in Mar 2011 was terminated in Jun 2013 even after extending his probation in May 2013.The reason cited is he has not disclosed a pending case (Marriage related)against him. The case is settled in Jan 2013 in Lok Adalat. He has got a notice by SBI in Dec 2012 reg the case and Case is settled in Jan 2013. The details are submitted by him to Bank.Later, after extending probation, he is terminated.

Probation is for a period of 2 years. After completion of 2 yrs probation period, Bank extended the probation citing a ground that the candidate has to improve the subject but not on the ground of the case. Later after extension of probation, within 1 month, service is terminated. The case is a false case Under Sec 417,420 Under sec 34 and also under sec 3,4 of Dowry prohibition act(resolved in Jan 2013 in Lok adalat)

The case came to the notice of SBI while making enquiry about antecedents. The judgement is given by lok adalat is a compromise award is given between two parties and the case is closed. The termination notice contained details of the sections of the case. But, it didn't mention about the case in extension letter given in Apr 2013."

Now what he had to do. Is there a chance of him getting back the job. Please guide

No claim lies for termination of services during probation. However, write to appointing authority and chairman of the Bank (Through proper channel with one direct copy)giving full details and prey for reconsideration of the decision.
