In andra pradesh - daughters right to property

(Querist) 13 October 2013 This query is : Resolved
I was told by some one that girls born after 1981 only are eligible for fathers property. Is it correct?

Is there any time limit to claim my share after my fathers death?

Regards
Madhavi

If you are a Hindu, if your parents died "intestate" means without writing a Deed of Will in favour of any one, if your parents did not divided into shares ancestral property as well as self-acquired property before 20-December-2004, then as per Hindu Succession Act, (Amendment in 2005) under Section 6 of that act, you are eligible to get your share from your parents property.

By showing cause of action you can file Partition suit before the Civil Court

someone wrongly told you that girls born after 1981 only are eligible for fathers property. That is NOT correct.

No !There is no time limit for claiming share from joint sharers but once it has been claimed but denied, suit must be filled
at earliest though limitation provided would 12 years from the date of denial.

I have never asked for property officially with my brother and it is still on my fathers name. But my brother is paying the housetax all these years. can I he claim ownership since it is in his possession? since my father expired 13 yrs back, can I caim now? or will I be rejected since it is more than 12 yres?

You can file your suit even according to Hindu Succession Act(1956_) as amended by Act 2005, since partition has not opened as yet.
