I have a probate of flat based on WILL of my mother. For enrolling as member, Society is asking in addition to other documents and forms INDEX II.

Pl tell me what is procedure for obtaining the same and who will issue it ?

Is any service provider is there for doing the same.
I am from Mumbai.

Seek advise of society managing committee to procure the forms, which are local (Mumbai or Maharashtra).

I even went to sub registrar's office, he asked me to get transfer deed.
He also advised me to go to a lawyer. I was told that once you get probate which took 18 months, all your problems are resolved but my issues are not ending.

You can get the certified copy of Index-II from the Sub Registration Office in whose jurisdiction your property is situated by making application in this behalf.

Total confusion done by society member in your mind.

1. Your mother may have purchased flat that document may be registered and of that document index 2 under registration act is made

2. Your mother died she made will , then you got probate . Once probate you got will is held valid

3. Now probate is issued by court

4. Now which index 2 society member asking show me act and rules ? What is in their mind . This all half baked committee members do such thing in my opinion . Any how if there is any thing different let me too get knowledge , law is vast and complicated field but to my best of knowledge index 2 you can get for original flat purchase agreement if registered nothing else

Well advised by Mr.Madhu. Once property is transferred to your name in the revenue records that meets the requirement of the society to ensure the ownership. Also check whether the requirement of transfer of ownership in property tax, water tax, electricity etc., are done based on the above.

Annual property tax if you are still remitting in the name of your mother to be changed in your name based on will and by approaching the corporation authorities. Like wise other documents like electricity connection, water connection etc., apart from change of name in the Taluk/village records. You can consult the property consultant or legal expert in the area for the right advise on putta transfer/in village records.

See myself outside Mumbai so little variation may take place because mumbai has old 1888 municipal corporation law we have different.

1. Property tax if directly coming on your name change name approaching ward office of BMC

2. Property tax if coming on society name then approach ward office and change entry of bhogwatedar of property tax . Means on bill society name is there but in record or detail calculation how it is calculated your mother name must be present

3. Other record is society but honestly I lack grip in that matter better avoid it because I may give wrong ans

4. Electricity bill , pipeline gas change

Apart from this according to me no govt record is there but if your property is that of mahada SRA cidco then other things are applicable
