Querist : Anonymous (Querist) 21 September 2010 This query is : Resolved
Please let me know the rules of inheritance of property under muslim personal law, both for the ancestral property & the self-earned property of a muslim male & female. Also the rules governing the will of muslim male & female regarding what percentage of wealth can be given away as per own wish and how the balance to be shared among the relatives.

sharers and residuaries will share the properties. In the self acquired properties during the life time he can dispose the properties, only after the death his legal heirs will succede the properties male will get double the female always.
Mohd., system of inheritance is very complicated if you want detail you can refer the Verma's Mohd., law.
Chanchal Nag Chowdhury (Expert) 21 September 2010
A Muslim can dispose of 1/3 rd. of his property, according to his choice by gift or Will.No Probate is required. For the balance 2/3 rd., the Rules of Succession as per Mohammedan Law will apply. This however, does not apply to sale of the property during the lifetime of the owner by the owner.
