Insolvency petition

(Querist) 18 October 2015 This query is : Resolved
I have received notice from court on insolvency petition filed by debtor. I want to counter the petition. can I attend court on my own as a CA because it is a financial matter. Is it mandatory to appoint advocate for first time attendance to court. thank you

If you are one of the Respondents, then in that capacity (party in person) you can appear and put forth your response. Similarly other respondents can do so for themselves. But you cannot represent others, as you are not an Advocate.

There is no need to appoint an Advocate, if a party is capable of representing itself and effectively handling the matter itself without the assistance of an Advocate.

You can appear on your behalf but not on behalf of others.

You can yourself argue your case as "Party in Person".
T. Kalaiselvan, Advocate (Expert) 24 October 2015
You can appear as party in person by expressing the same before the court on appearance.
