If any of the offences are not found to be made out during investigation, the police can chargesheet them only under sections whose ingredients are satisfied. or if the police has charged - the magistrate is free to discharge if the charge against them appears to be groundless.

It is the investigating agency who is responsible to collect evidence. If investigation revils that there is no material to fulfill the require ment of a penal provision under which the case was registered but find enough evidence of another penal provision, the i/o has the every power to submitt charge sheet under any suitable penal provision.
Moreover, if police submits charge sheet under any penal provision, it is the duty of the court to examin the case record and frame charge under the proper penal provision . He may frame charge under the same section submitted in the charge sheet or may add or may frame charge in a different penal provision by applying hi s judicious mind.
