Dear Preet, First you have provide answer whether gratuity is subject to tax or not. That is the precise question. Instead you say no. If no tax is payable on the Gratuity, then why will the employer effect TDS on the amount of gratuity paid?

Gratuity received from Government Employer is fully exempt from payment of tax. Gratuity received from employer other than government is exempt upto Rs. 3.50 Lacs subject to certain limit.
