Hello ,

My Friend had purchased a Residential Property in New Delhi with some other person namely A having 50 % share in the Property.

On the same date i entered into an MOU and Agreement to Sell of the same property with my Friend wherein he had sold half of his share whish was 25 % of his 50% Share of the property to me and as per the Agreement to Sell and the MOU he had clearly mentioned the details of his holdings in the property and also of the Mr. A but the Agreement or the MOU was not signed anywhere by Mr. A as it was a deal between my friend and me.

Mr A and my friend sold the property and my friend duly paid me my share in the property which was 25 % share.

My Ques. are -

1. Could he enter into any Agreement to Sell with me on his 50 % of share.
2. Could he and me have a joint venture as such in his 50 % of share in the property.
3. Can i issue him an affidavit( as he is asking me one) now declaring -
a) the details of this transaction.
b) the details that i have received my profit on this deal.
c) that i will be liable for tax on my profits.
4. Can one issue an affidavit to any person or is it always declared for the purpose of Govt authorities.
5. Can i issue him any other document instead of an affidavit which will solve his purpose for his taxation purposes.
