If his retrenchment is illegal then he can avail the provisions of Industrial Disputes Act, 1947 and first of all he can serve a demand notice and then for reference and can approach labour court.

the applicability of id act 1947,depends upon the status of employment like salary and designation as all are not governed by id act.
