Landlord harassing tenant

Querist : Anonymous (Querist) 07 May 2024 This query is : Resolved
Hi,Can anyone help me out.My landlord is not renewing rental agreement and continuosly increasing rent .How can I address him?
T. Kalaiselvan, Advocate (Expert) 07 May 2024
You cannot force the unwilling landlord to renew the rental agreement.
If he is increasing the rent every year it is but normal and yo do not have any point to dispute it.
however if the increase is abnormal and not within the purview of the law of the land, then te tenant can rent controller court with an application for fixing a fair rent.
As per the laws, the landlord cannot evict the tenant for five years if all the rent is paid on time. However, the landlord can ask for eviction if he needs the property for personal use. However, the ground for eviction should be valid in the eyes of the law.
You may consult a local lawyer and proceed as per the suggestions made

Yes. You cannot force the landlord to renew of rent period. Amicably settle the issue.
Advocate Bhartesh goyal (Expert) 08 May 2024
Since your rent agreement has been expired and it can be renewed only when landlord agrees so better get landlord in confidence else he may sue you for eviction.

If the enhancement in the rent is abnormal, you may seek relief under the local rent law. As the first step, you may serve a legal notice.
T. Kalaiselvan, Advocate (Expert) 11 May 2024
You can refuse to pay the enhanced rent amount if it is abnormal and against natural justice.
You can file an injunction suit agaisnt the landlord to restrain him from evicting you forcibly other than by due process of law and also an application to fix fair rent.
This will be the temporary relief to you ow after which you can sort out the issues by compromise/reconciliation or negotiation
