Latest ammendment in Section 138 of N.I.Act

Not one month , it is 30 days as there are months with 31 days also.

But you can file with condonation of dealy application this provision was not there earlier.

As per the amended act statutory notice informing the dishonour of the cheque and demanding the cheque amount has to be issued with in 30 days from the date of return of the of the notice giving 15 days time to the drawer of the cheque to make payment. Failing to make any payment complaint can be filed within one month from date on which cause of action arises ie, after expiry of the grace period.
