Leave and License Stamp Duty

We want to execute leave and license agreement in Maharashtra. Monthly rental is 14256/- and it is for 5 years.
pls advice what will be the stamp duty.

Get hold of the schedule of Stamp Duty as applicable in Maharashtra. U can calculate it yourself easily.

With effect from 17-05-2010, the rates of stamp duty payable on L/L Agreements in Maharashtra are as under:
2,50,000 to 5 lakhs -- 1200/- per year of license.
5 Lakhs to 20 Lakhs -- 2000/- per year.
The amounts mentioned above are annual compenstaion + Security deposit. Dont enter into agreement for more than 5 years.

Dear Mr. Ashutosh,
Deposit is taken as security for the proper compliance of the terms and conditions of the LL agrmt and also for recovery of any of the dues from the Licensee. Hope these terms are contained in the seprate agrt. for the deposit executed by you. It is likely to be regarded as part of the LL agrmt and requiring stamping and registration. Therefore I would strongly recomend to register it along with the LL agreement and pay the stamp duty and registtration charges on it. If however u choose not to register it and take the risk (it will be ur choice), then u may pay the stamp duty on the annual License fee as per the schedule indiacted by me.
