Left co without serving proper notice period

(Querist) 01 March 2014 This query is : Resolved
Hi

I had to leave my previous employer PRECISION without serving the required notice period of 3 months due to some unavoidable personal reasons.

Now they told me that they will take legal action against me & not settle my F & F & they will recover from my PPF Claim.

What should I do? Does anyone know if these companies really take legal action or are they just trying threat tactics?

i am in this co. by last 1 year and they mentioned in their appointment letter that we need to serve notive period 3 months after cofirmation.

I am confirmed also but i didnt get any confirmation letter from co only recd single mail that you confirmed from HR but i have not replying on that that mail or not given any acceptance.

Please suggest

The company can take legal action for not abiding by the terms of agreement. A legal case can be much more costly and troublesome for you than what becomes due from you as per the terms of agreement for F&F settlement.

So, better settle with the company, by depositing the due amount in lieu of notice period.

I fully agree with the opinion of expert Mr. Dingra o the subject. Thus, instead of wasting time, energy and money on unnecessary litigation it is always better to go by the terms and conditions of the offer letter/appointment order of the company. Agreed with experts.

If there were some unavoidable personal reasons it was better to take Line Mangers, HR into confidence and seek waiver of notice period/pay and/or early relieving by tendering reasonable notice period as settled amicably, completing tasks on hand, handing over the charge: company property, training the designated employee and tendering notice pay..................

Such matters are best resolved by applying goodwill, rapport and exceptional levels of persuasion, persistence, negotiation, reasoning skills.

Employee should avoid litigation.
