1. The person seems to be in hurry to be entangles in legal dispute and hence he is sending the legal notice. His act not only ill-advised by also smack of grave legal consequences.
2. I can not put any ill-advised points further.
3. If he wants to compound his position in legal terms then he can send the notice.

The Notice could be counter-productive. She would claim maintenance for herself and children. And, it could be that she would accuse you on real as well imaginary grounds.

The fact remains that kids are yours. If the lady wants to live alone you must pay her adequate maintenance considering she is the mother of your two children .

your specific questions are replied as under :-
1)They are not legally wedded so legal notice will be valid?
YOU ARE JOKING.
If you keen on regularising here claim for maintenance or keen in going to jail on rape charges then go ahead.
You are also not sure if she is divorced. SO if keen on going to Jail on charge of adultery then go ahead. (YOU HAVE NOT REPLIED MY EARLIER QUESTION)
2)what are the important points to considered to give legal notice?
WHILE GIVING THIS NOTICE (for which you will have to find some starving scrupulous lawyer) YOU HAVE TO BE ABSOLUTELY CLEAR THAT YOUR EXPE3CTATIONS ARE ILLEGAL AND IMMORAL.
3) will give legal notice or not? P
NOT UNDERSTOOD WHAT DO YOU MEAN.
