We want to allow a manufacturer to put up his plant (Klinker) for using fly ash generated from our power plant. 100% disposal of ash is a condition given by CPCB while allowing to put up this plant.
Our land can not be leased out to any third party as per provisions of the lease agreement with Orissal Govt.
Can we entre into live and license agreement. In that case who will take factory license and take care of other legal formalities.
An early reply will make me enable to take decision.

the lease deed may prohibit creating of any thrid party rights . scrutinise the lease agreement whether it prohibits you from giing land on leave and licence basis too

Yes Leave and License is a good option if indeed the lease is prohibited by the govt.
