Lowering the mandatory age for marriages

(Querist) 15 February 2013 This query is : Resolved
Early marriage as a solution to reduce incidents of rape, which have soared in recent months in the whole country. It is time to look seriously in the matter of the present mandatory age for girl 18 years and boy 21 years should be lower as the age of girl 16 years and the age of boy 18 years. The law makers should consider about the lowering the mandatory present age of bride and groom. The Government of India and law ministry should consider the present need of reducing the age for marriages in India. The Government of India requested to take necessary steps and obtain scientific advice from the Indian medical council in this regard.
All the legal experts of this forum invited for healthy discussions in this regard in the interest of healthy and sexual crime free society .

it is duty of govt.
prabhakar singh (Expert) 15 February 2013
I wonder how can it be a solution to the offense of rape in the country?

Quite strange and sounds like a fantasy.
R.K Nanda (Expert) 15 February 2013
we as experts cannot do anything directly

unless govt.make new laws for it.
prabhakar singh (Expert) 15 February 2013
Mr. Nanda !
The author is also an expert.

He suggests that "puberty" should be the age of marriage.

But the big thing is that how can it eradicate RAPES.???
R.K Nanda (Expert) 15 February 2013
lowering marriage age is not going to stop

rape.rape laws must be made more hard and

penal.

I know author is also expert of LCI and that

is why i stated that we as experts including

author cannot do anything directly.

Dear Nanda ji,
Thanks , you said we experts can not do any thing directly. I simply suggested my view to the Government of India and Law commission , and law ministry. If you all supported in this matter definately the law commission and Government of India will take necessary steps. We are the leagal experts, it is our duty to guid and propose the Government for making required laws in the civilised society.

The idea seems good to me , in foreign countries the number of rape is less because they have access to everything at a very younger age

A "gone case"

THERE IS AN OLD ADAGE FEARING 'BED BUG' ONE SHOULD NOT SET THE HOUSE ON FIRE!

LIKE-WISE FEARING RAPES WE SHOULD NOT DO ANYTHING UNDER A KNEE-JERK REACTION!

BY SUGGESTING TO LOWER THE MARRIAGEABLE AGE, ARE WE HEADING TOWARDS THE CHILD MARRIAGE ERA?

I THINK WITH VERY LIMITED KNOWLEDGE, IN OUR ZEAL TO PROVIDE SOLUTION TO A PROBLEM WHICH WE DO NOT EVEN COMPREHEND IN ITS FULL GAMUT, WE SHOULD NOT DO / SUGGEST ANYTHING WHICH WILL BE WORSE THAN THE DISEASE.
prabhakar singh (Expert) 15 February 2013
I EXPECTED YOU TO FALL DIRECTLY OVER MOTIVE OF THE AUTHOR Anirudh JI. AS HE WANTS HIS PERSONAL LAW TO BE A CIVIL CODE IN INDIA IN DISGUISE OF SOLUTION TO RAPE WHICH REALLY IS NOT EVEN IF LEGISLATED AS PER HIS DESIRE.
Khaleel Ahmed Mohammed (Querist) 16 February 2013
Dear Prabhakar ji,
This is not the matter of Muslim Law. It is the present burning need in the so colled civilised society. I think you are aware of the rural population, majority belongs from Hindu religion. where people indulged to perform their children marriages below 15 years as misrepresenting they attained the required mandatory age.
Further during the school studies , I think since 6 th standards children are taught about sex. You are aware we are living in different countries , but now the global world is single village through internet connectivity. I think you have observed , student of third class using internet independetly. Allmost all internet cafes teen are watching porn videos and films. Please observe in the city parks and open public places of our country, what teen age groups are engaged in what type of activity. You may get the age group data of valantine celebration .You will know below 15 years children celebrated valentin in majority by illegal sexual activities in the open parks. Is it good for our so called civilised society. In these circumstances if we remove the legal hurdle of marital age what will be wrong.
prabhakar singh (Expert) 16 February 2013
Dear Mr.Khaleel !
I do not propose to deny what you have just stated yet I am not convinced that if age bar for marriages is reduced to puberty then there would be no scope for the offense of rapes .
Adv Archana Deshmukh (Expert) 16 February 2013
Marriage has also to do with emotional maturity, understanding capacity, capacity of taking responsibilities etc, which may not be there at a small age. Also I am not convinced that lowering the age of marriage will be a solution that will stop the offences of rape.
R.K Nanda (Expert) 16 February 2013
agree with expert archana.

The intention of Khaleel cannot be questioned at any stage. The recent incidents have definitely lowered down our age old image in the minds of whole world. The youth, which seems to be indulge in such incidents and also alleged by Khaleel, was himself on streets on this issue and it forced the veterans to take action against such increasing incidents.

This is very positive sign on the part of young generation that it also wants a due regard towards the females in our society. Law what so ever stringent it may be, cannot stop such incidents unless moral values of the society are high.

We have seen recently incidents of same nature in Suadi Arabia wherein criminal laws are purely on Islamic way and are very harsh but even then such incidents do occur and people are also publicly punished and even killed by law enforcing agencies so as to teach society a lesson.

Moral values were the base of Bharat wherein it all females except wife were treated as sisters and mothers. Now western effect has come to our blood either through modern way of life, media and so on resulting which such incidents to which Khaleel has pinted out are common.

BUT even then the solution suggested by Khaleep is not the way to mend such increasing tendency. We, the social workers and all other social, religious, media, educational institutions and over all every responsible person of the society should produce his own example before the young generation which shall ultimately be followed by them today or tomorrow.
