DEAR FRIENDS,

KINDLY LET ME KNOW WHETHER A PERSON BEING THE OWNER OF THE VEHICLE WHO HAS INSURED ON HIS OWN NAME (OWNER CUM DRIVER), CAN CLAIM COMPENSATION FROM THE INSURANCE COMPANY FOR HAVING HIMSELF DRIVEN THE VEHICLE AND SUSTAINED GRIEVIOUS INJURY.

certainly, the victim of an accident can claim the compensation from the insc co. not only the driver but also the owner himself can claim the insnc.co to indemnify the loss or even damage sustained.riven

No. Any negligent person cannot file claim petition against himself though he may be injured driver of the offending vehicle and at the same time owner. Had he not be owner of the vehicle, even then the driver of the offending vehicle is not entitled for filing the claim petition under MV Act before MACT against his owner. There are numerous citations on this point.riven

If comprehensive insurance is taken, even negligince will be covered under the policy. However intensional acts will not be covered.
Therefore owner will also get compensation for injury besides damage to vehicle.riven

If you have comperhensive insurance you can claim compensation subject to you have valid licence & your negligence.riven
