Maintanance

(Querist) 28 August 2011 This query is : Resolved 
The lower court has ordered me to pay Maintanance to her. She has not taken any divorce from her 1st husband. Second died. mine was third to her.i Am going to district court for review. Is there any chance for me to win the case ?? Can u ref any judgement in similar cases.

if at the time you married her if she had any alive husband legally married to her then marriage solemnized with you as second or third is void and you are not liable to pay her any maintenance.

I think already you posted this this query. Now with some altered words again posting. Am i right.. Any way, while her first marriage still in force you not responsible to pay maintenance. But the lower court ordered to pay maintenance. You have to challenge it before appellate court. Don't know what where doing while your trial.

The marriage with U is illegal. The question of maintenance does not arise. U should ask the court to take it up as a preliminary point.
