Maintenance charges

Dear Experts
I am a flat owner in a multistoried building that has 177 flats. The builder while executing the deed for undivided share of land and sale deed of flat mentioned in them that the maintenance charges payable for common facilities to be enjoyed by the owners will be based on built up area of respective flats.. The method was followed for 8 years. Now association of owners feel it is time the method is reviewed, as the common facilities are same irrespective of size of the flat and all owners are to share the expenses for maintaining equally.
Will the move of association amounts to violation of laws as the deeds mentioned above are signed by all owners and registered?

where are you located? is cooperative society formed ?
if cooperative society formed then you would be governed by provisions of cooperative societes act wherein for common amenities the maintenance charges would be equal .

Dear Mr. Sethy,
I am in state of Tamilnadu and our association is registered under The Tamilnadu Societies Act 1975.
If you happened to have the Act please advice the Section of the Act Governing the maintenance aspect.
