Marriage

(Querist) 28 October 2011 This query is : Resolved
hi suppose one hindu boy puts vermillion on the forehead of a scheduled tribe girl in a temple who has already maried earlier to a muslim boy or a christian boy and staying apart now is it will be considered that the boy is married in the eyes of law
Ravikant Soni (Expert) 29 October 2011
No, by reasons two:

One : only putting vermillion on the forehead does not complete the necessary ceremonial preconditions of a valid marriage.

Second : The girl is already married, so her second marriage upon subsistence of first have no legal recognition.
adv. rajeev ( rajoo ) (Expert) 29 October 2011
She is married unless she got divorce from her first husband it is invalid.
And the marriage is not complete, because due procedure is not followed.
But now a days everything happens. If they regd., their marriage and lived together as husband and wife there is no problem.
It is modern era.

Totally agreed with the experts, just by putting the vermilion on the forehead in the temple or if the women is married and not legally divorced, her second marriage is not legal. But, to entice and fool the married but separated women on pretext of marring her and by just putting vermilion on her forehead in temple and then trying to safeguard oneself from any arising legal issues and trying to get rid off that women is certainly a crime.

Unanimously the marriage is void ,no marriage in the eye of law.And it is good otherwise every HOLY every one would be burdened with
a newer one on the theory of the author.
