Married daughter's claim from her father's property

(Querist) 28 January 2014 This query is : Resolved 
I AM 63 YRS AND MY WIFE IS 57 YRS (DOB:01/05/1956) HER FATHER DIED IN 1998 AND HER MOTHER RECENTLY ON 2nd JANUARY 2014. MY MOTHER-IN-LAW HAD INHERITED PROPERTY BOTH AGRICULTURAL LAND OF 12 ACRES AND A COMMERCIAL BUILDING. COMMERCIAL BUILDING WAS SOLD BY HER BROTHERS 2 YEARS BACK WITHOUT MY WIFE'S SIGNATURE OR CONSENT. ONLY 12 ACRES OF AGRICULTUAL LAND IS THERE. CAN MY WIFE CLAIM A SHARE IN LAND?, HOW ABOUT THE SALE OF COMMERCIAL BUILDING 2 YEARS BACK? CAN WE PROCEED WITH COURT CASE AGAINST HER BROTHERS.

During life time your MIL had not made any arrangements regarding the properties then your wife can claim her share becuse she is legal heir of the MIL

HOW ABOUT THE COMMERCIAL BUILDING SOLD BY MY BIL WITHOUT MY WIFE'S SIGNATURE. CAN WE PROCEED AGAINST THEM FOR COURT CASE. CAN MY MIL MAKE ARRANGEMENT FOR GIVING PROPERTY
ONLY TO HER SONS, SINCE IT IS ANCESTORAL PROPERTY.
PL REPLY SO THAT WE CAN DECIDE WHETHER TO GO TO COURT OR NOT.

Your wife has share in the Agr. Land. She would get any thing from the sold out commercial building is doubtful.
