Matter did not get called out but order passed

Hello,

I am still learning, so plz bear with me. Here is the situation:

The matter was listed in Calcutta HC daily cause list under "to be mentioned". However, it did not get called out during the day but an order been passed by honorable court to list the matter again after 60 days.

Can a honorable court pass an order w/o calling out the matter, if the petitioner wants an early hearing/ interim relief what can be don in this instant case.

It is handling under court case list mechanism.
So if someone want it fast he can go for fast-track court too.
But this is depend on case to case

Dear Mr. N Kumar,
If you want urgent relief in that case you have to file interim application. You also have to mentioned the matter before court for hearing of urgent relief.

Mentioning --- To be Mentioned --means -- involves -- bringing up a case in front of the Court ahead of its listed date on the grounds that matter needs to be posted urgently

When the Court had given an opportunity to Mention you had not understood that

Mentioning to be done before the concerned Judge before the Hearing could start or before the Judge leaves the Court after hearing is completed

Still you could mention this to Concerned Court's Judge and Plead for urgent hearing. If you sit and watch this in High Courts you would find many Advocates pleading this before and after hearing

Another method seeking Urgent Hearing is by submitting a Requisition to the concerned Court's Registrar with valid grounds for the urgency

Thanks Mr Rajkumar, Are you saying that if a matter is listed as to "be mentioned " in daily cause list and not heard, it will automatically get an order published as to list the matter again after 60 days

First Do not use the word as Ordered it is only Posted

When no one represented and mentioned the pleading for urgent hearing the Court would automatically post it for a longer date only enabling the representation

More over if your matter is in High Court there could be no question of Transferring it to Fast Track Court please
