Memo by in persson through reg post with ack due to fmmc

(Querist) 15 November 2011 This query is : Resolved
Hello Forum Members,

A memo [in 498a case about interim order] can be filed in person to First Metropolitan Magistrate Court through Registered Post with Acknowledgement Due. As such, the party belongs to a different city.

Advice please.

it is advisable for party to place on record interim order passed personally or through a lawyer in Metrpolitan Magistarte court

There is no such provision of interim material order in 498A proceeding so further question do not arise.

Dear Makkad Sir,

There is an interim stay order[quash]for A2 & A3 in 498a case from High Court.

The lower court did not receive our interim stay order.

To file the memo in FMMCourt we have contacted our adovcate[who filed bail petition] he, said we have to give new vakalat.

Further, he went on foriegn assignment.

As A1 & A2 got interim stay order for quash, instead of atending adjounraments

Can they file memo in person[by A1 & A2 with signatures] to submit the interim stay order, through Registered Post with Acknowledgement Due.

Hope query is Clear!!!

Answers please...
