Merging of two flats
Hi I'm MrX
(Querist) 02 May 2017
This query is : Resolved
I am purchasing my Adjacent flat.
Both the flats are separated by a Single Brick Wall which connects both the Living Area, I want to make a pass-through in the wall which connects both the living room..I do not want to break the whole wall but just a passage in between.
What are the requirements and how do I go about with these changes...
1) I have already asked an Architect to give me a written letter stating that the changes I do to the room are not damaging or effecting any Load Bearing Walls or Pillars or Beams.
2) I will give the Architects letter to the society notifying them about the changes?
What else has to be done? Do I have to take give a letter to the BMC? Bcoz I read that now there is no need to take permission from BMC for such modifications

1. Merging of Two Flats (in whatsoever manner) is classified as "amalgamation", which is a punishable offence with penalty /imprisonment, under the BMC Laws.

In one such case penalty was levied as per publication at:

"I respect the honorable members on this forum, and just having "Hey" in my username does not make any difference to my views for the experts replying to this thread"
Coming back to my initial question, thanks for the references of the articles which makes it clear now that altering the wall which is separating the flats is not easily possible..
But I have seen many cases such as this article
http://realty.economictimes.indiatimes.com/news/regulatory/renovating-flat-in-mumbai-no-need-for-bmc-nod/52117302
Where it says
"As long as the load-bearing walls or pillars are not touched, the civic body will not interfere during the renovation of a flat, municipal commissioner Ajoy Mehta said on Wednesday. Only the toilet and kitchen areas cannot be shifted inside a flat as it may cause leakages in neighbouring apartments."
Also asking on other forums, some say
"Obtain approved Architects Certificate and issue Notice to the society enclosing paper clipping with copy marked to BM"
So now this question is just beating round the bush, I understand this is an open forum and all Experts are volunteers and I appreciate every reply..but would really appreciate even more if the replies are pertaining to the question and not regarding my Username and stuff..
Best Regards
MrX

"I understand this is an open forum and all Experts are volunteers"
Who has informed this to you?
Is it published?
There are open declarations and admissions in threads that monies/FEE has been asked , demanded, received, collected from authors/querists, and enjoyed.

Sir,
You need a permission in writing from:
[1] The Managing committee of the Society and [2] from the Building and factory department of MCGM office of your ward. These are MUST for the structural change that you propose to undertake in your flat.
Since you say that the alterations are legally permissible, it will be in your interests to get the written permissions from both the authorities above.
Good Luck,
Kishor Mehta

@Kishor Mehta Thank you very much for your precise answer to my query.
I thank Sir @Kishor Mehta and @Hemant Agarwal for their time and their valuable reply which is highly appreciated.
I think the forum moderator must delete replies which do not relate to the question asked.
Also members should read the

Which says
"Be eager to learn and share. We at LAWyersclubindia intend to create a knowledge base. A portal wherein you can gain, exchange and spread knowledge. and

and
"Do not reply to threads with messages like I agree thanks, etc etc. Instead use the thank user icon just below the profile detail of the user in each post.Try to add value with your each post. Member found using different tricks to increase the points will have there points moderated and reduced."
So its obvious that replies which are NOT AT ALL related to my original query are just replies done to increase points.

@N.J.S.Rajkumar alias narasimha
I was not going to reply because I was more focused on getting my query resolved, and not waste my time by arguing over a discussion which is not at all required.
But I will still answer your questions
1) Yes I changed my Username from "Hey" to "Hi" bcoz I really felt "U" were personally offended by the username and so "Respecting You" I changed it and requested in my above post that the discussions in this reply be related to my Query and not with argument on what my username should be
2) If I visit courts and if Hey would be permitted or not
It does not matter at all because I will be using my REAL NAME there and not a USERNAME. So your statement is not logical at all.
I did not IN MY POST say "Hey" in my post when asking the question, ITS JUST MY USERNAME if u are so offended by my username PLEASE DO NOT READ MY USERNAME.
3) Why Dont Mr.X fill your profile
Why would I do that? its my wish and I sense threatening speech in ur reply, I wish to be anonymous for "anonymous" reasons and NO WHERE IN THIS FORUM is it mentioned that I HAVE TO USE MY REAL NAME.

SO I AM ONE SUCH USER OF lawyersclubindia.com that DO WANT WANT THEIR PERSONALLY IDENTIFIABLE INFORMATION MADE AVAILABLE.
I hope I have resolved your queries where Infact I was looking to resolve my queries.
Also when u say I don't have the decency of saying Mr. I said "I thank Sir @Kishor Mehta and @Hemant Agarwal" so I used Sir and not directly the name.. let me elaborate to you the usage of SIR and MR
"Mr." coupled with the person's last name is typically used as a formal salutation. A letter with the salutation "Dear Mr. Austin" is more formal than "Dear Sam." If I received a letter with the salutation "Dear Sir," my first reaction would be that it came from an impersonal bureaucrat, although one more personalizing than "To Whom It May Concern" (because at least the salutation included my correct gender!).
So as per the above definition Im not addressing any of the respected members who replied by their last name so I DO NOT FEEL the reason for applying Mr there..
"Typically addressing anyone as "Sir," it connotes respect."
So this is what I did for the respected members.
Also if you go through the policy of this website I can point these which you have violated so please stop this discussion as its unwanted.

Now can we please stop this discussions, U did not answer my query but u posted here 1) to correct my vocabulary, 2) to sarcastically argue with me with regards to MY USERNAME which should not be your concern, 3) You are asking me to disclose my personal information where I feel its my Privacy right not to disclose.

Persons with never ending sarcasm, indecorous, abusive conduct of.............( Not at all hard to guess)...............should be permanently and forever rejected, shunned, and shunted.
LCI shuld have NO place for such persons even if he/she is very old in age.
Age alone does not fetch tolerance from others even LCI as platform is an ANNDATA (provider) for aged and old persons.
