Dear Sirs....I had got a flat from Mhada in a lottery in 2006....I wish to purchase another flat now in the same society in my name or a joint name(1st-wife-2nd-me)...Can I legally buy the flat in the same mhada society given the fact that it has completed 5 years and I would be buying the flat from the 1st owner at the market rate and not the mhada discounted rate.....Thanks/Pankaj

obtain society permission for purchase of another flat in your name . without society permission you cannot purchase another flat in your name . yo avoid complication buy flat in your wife name only

Dear Sir...Thank you for the quick reply....The society has no issue in giving the NOC either in my name or my wife name....My query is "can I be challenged by Mhada for buying this 2nd property and will I get into any legal complications"....Thanks/Pankaj

the first flat is in your name . second flat buy it in wife name . if society has no objection you can purchase the flat . to be on safer side visit MHADA office and make enquires

Also, I can buy the flat in joint name with my wife's name as 1st name but cannot entirely buy the flat in her name as she would not be qualified for the loan for the said flat....Thanks/Pankaj

you name should be second in the other flat being purchased by you .

Despite of your all arrangements to hide your name, NOC by society and so on, it shall be better for you to visit the official site of MHDA and consider those before moving ahead as any person during your life time may make complaint against you and in that event, you shall surely remember this site and advices given to you.

Dear rajkumar sir....there is no clear communication on the resale flat on mhada site.....however as per mhada rules an allotee cannot sell,rent his flat within first 5 years of allotment which is not applicable in this case...pls advise

If MHADA rules do not prohibit to purchase second property then you may go ahead without any hitch.
