Land was bought by Mr X in 1955(Delhi). In 1965 mutation was done in the name of Mr x. Mr X moved out of station for personal reasons. In 1982 Mr X expired. Mr X had 5 legal heirs. As they were not aware of the location of the land they approached revenue department in 2007. (Note: Initially the land was empty and now the area is densely populated ). Now revenue department is not doing mutation in the name of legal heirs of Mr X. what should be done to get our land with possession and mutation.

Dear Narinder,
U do one thing file an application again for mutuation. Once again ur application is refused then file an appeal before Asst., Commissioner against the order of the Tahasildar.
One thing possession cannot be given by the Revenue departion.
To get the possession u will have to file a suit for possession aginst the persons who are illeally occupied ur property.

In my opinion for possession you have to knock the door of Civil Court and remember within 3 years of the cause of action you have to file the case otherwise it will be barred by limitation and for mutation you have to appeal as said by Rajeev Ji.

FILE A CIVIL SUIT IN THE CONCERN CIVIL COURT FOR ORDERING THE MUTATION BY REVENUE AUTHORITIES, IT ONLY HELP ,EVEN IN CIVIL SUIT ANY DELAY,OR ADVERSE DECISION U GOT,STRAIGHT AWAY KNOCK HC UNDER ART.226.
