both husband and wife will have to file consent divorce petition. You cannot take divorce without approaching court because only civil courts have got divorce power. Marriages are made in heaven but divorce in court only.

I agree with Rajeev sir with minor altration, that is, in metropoliten cities the family court and in other places only senior civil judge having jurisdiction to try the divorce cases

You will have to file a consent divorce petition in the court of Distt. Judge, you both will have to present in court on first hearing and have to give your statements accordingly. Court will give a next date of after six months and on that date again you both will have to give statements and on the consent of both the parties the court will pass a decree of mutual divorce. Court can impose any condition if the parties have issues.

Divorce can be obtained by mutual consent by filing a joint petition before the Court.
Only courts can dissolve a marriage by a decree of divorce.
