My Dad was worked in a Private limited company for more than 11 years in GET Power ltd Chennai.
He is Assistant Manager Construction.
He resigned the job (Apr 2015), now working in a different company.
But the Salary was still pending. More over all the finance dept guys are also resigned. No one in the company. No one to contact.
Salary permonth is nearly 49,000. Plus Allowance and Medical Reimburse 6000 Permonth. TOTALLY 8 Months amount pending. Help anyone to get that money. Advice any good lawyers in Chennai. Please. Thank u in advance.

The company was Acquired by a another company named TECHPRO SYSTEMS LIMITED DELHI before my dad resigned.
Now there is new no activities in the company. All works which was pending is currently processing.

We have all the proofs that salary is not credited. OLD Payslip, Bank statements, etc.
I like inform, that we have already claimed PF Benefits. Claim is under process.

Issue final representation to good offices of appointing authority,MD,Chairman and demand to supply the salary slips/FnF statement/payment of all pending dues/PF a/c slips/Form 16 etc say within 15 days.
If good offices also do not provide relief approach your labor law consultant and issue legal notice and approach court of law.
Unpaid dues are debt on employer.

What has been father doing all these days without taking any effort to claim his salary?
He can consult a local lawyer and send a legal notice to the company claiming his arrears of salary, if the company exists, there is no necessity for the staff to remain, even the new staff shall be able to give a proper reply.

Normally PF settlement can not happen without endorsement from your employer. If they have endorsed it and forwarded to RPF office, without paying salary EPF contribution would not have been deducted and remitted to them. This may also be seen from the perspective of additional evidence for claiming default salary through a lawyer specialized in service matters locally.
