My right as a first party for property aggrement

I received earniest money for a property. the last date was 25/Jan/13. But the second party is not paying the rest of money. can i sale this property to other.I m ready to refund the earniest money and want to sale this property to other. K P SINGH -09810118359

If the stipulated period mentioned in the Agreement is over to execute a registered Deed of Sale,then you can send a Lawyer's Notice to the Purchaser by rescind the agreement and calling him to collect the advance money through cheque.After completed this formalities you can sell the property to others.

You have not told whether you got marked your presence in the office of the registrar on the fixed day of registration of sale deed or not and whether you sent the notice thereafter to the buyer or not and if you have done so and have intimated him to forfeit the earnest money or to refund it as per agreement then you may go ahead as desired otherwise your step shall be highly dangerous for you.
