Need info about noc

Hello Sir,

Few decades back my grandpa ( my mother's father) took Half acre commercial land and now he is no more, my mother has 3 brothers and 2 sisters, during my grandfather's last days my meternal uncle forcefully asked my grandpa to transfer that land to him, unwillingly my grandfather did the same.. now the land is on my maternal uncle's name

Now my meternal uncle is asking all the siblings for NOC as some Government authorities asked him to get the NOC for that property dealing.. . and we are not ready to give him NOC since he has planned to take that land all by himself

now my query is, can we drag him to court and ask for equal share? or do we get any share? my mother got married in the year 1988

please assist

Was the property self earned ? If so you will have right over it and refuse.

It will depend on (1) whether it was self earned property of your maternal grandfather? (2) the validity of the document under which it was initially transferred to your maternal uncle, whether it was duly stamped, executed and registered. If it was so he has become the absolute owner.
